On 21 February 2008, David Elliott of Moore Stephens LLP was appointed liquidator of Phones 2u Direct.co.uk Limited.
What will happen now?
The liquidator will now undertake a number of tasks, including:
- realising the assets of the company;
- investigating the background to the liquidation; and
- dealings with creditors’ claims
Creditors’ claims
As well as claims from suppliers, there are a number of customers who have either submitted cash back claims or have claims that are due to be submitted. A copy of the report that has been circulated to known creditors is attached in pdf format below:

Please note that your obligations under your sale contract will continue, even though the company has been placed into liquidation. Consequently, if you have any outstanding cash back claims to make, these will need to be submitted as they fall due.
As a result of the extended claim period that exists under the contracts, it is estimated that claims may continue to be received until June 2009 and that any dividend that may become payable will not be distributed until at least September 2009.
The liquidator is unable to make individual payments to creditors as they submit their claims. Only once all claims have been received will the liquidator be in a position to make any distribution to creditors.
Reports to creditors
The liquidator is required to report to creditors on the progress of the liquidation annually within three months of the anniversary of the liquidation. Therefore, creditors will receive the liquidator’s first report by 21 May 2009
Contacting the liquidator
All claims received from creditors will be acknowledged by post as quickly as possible. Please ensure that you submit your claims by post only. Also please note that once your claim has been acknowledged, you will then receive the annual report referred to above.
