Litigation Support : insurance

Our clients recognise the experience and depth of industry skill brought to bear by members of the Forensic Accounting Services team. Recent assignments include the following:

  • A series of forensic accounting assignments on behalf of a major group of failed insurers. This included carrying out reviews of certain accounting matters spanning a period of over 20 years and the preparation and submission of expert reports.
  • A formal investigation commissioned by the Lloyd’s Regulatory Board into a Lloyd’s broker and its conduct in the placing of business with underwriters. The investigation required the analysis of numerous very complex reinsurance contracts and an assessment of the quality of the company’s compliance department.
  • A formal loss review commissioned by the Lloyd’s Regulatory Board into the asbestos, pollution and health hazard ('APH') problems of the 1984 open year of account of Syndicate 604. Although APH problems affected many syndicates at Lloyd's at this time, this was the only loss review commissioned by Lloyd’s that focused exclusively on the subject of exposure to APH claims and the directors’ management of them.
  • A major programme of work for Lloyd’s lasting some 18 months immediately prior to the successful establishment of Equitas in 1996. This included a review of the data quality for the whole of the Lloyd’s market for the years 1986 to 1992; the preparation of benchmarking reports on the reserve adequacy of the Lloyd’s motor market and other classes of business, and the assessment of the suitability of certain agents to act as run-off contractors to Equitas.
  • A confidential enquiry under Section 447 of the Companies Act 1985, carried out on behalf of the Investigations Division of the DTI, into specific transactions undertaken by certain authorised insurers. Following the submission of our report, a number of directors were disqualified from holding office.
  • Advised lawyers on a potential professional negligence claim against the former auditors of a substantial insurer in the London Market. Our role included identifying documents for potential disclosure and assisting Counsel in drafting the resultant claim and response to defence.
